Dueling Congressional Ads Contain Facts, Fiction

Vote 08: Facts Or Fiction Series Examines Anti-Polis, Anti-Fitz-Gerald Ads

With the Democratic congressional primary heating up, two ads are running that are attacking two of the candidates for the Second Congressional District.

One ad, run by an independent group, questions Jared Polis’ education record. A second is a Polis commercial attacking Joan Fitz-Gerald and oil lobbyists for allegedly being responsible for the Polis attack ad.

Both ads have factual information but also misleading or fictional claims, a review by 7News found.

"Let's look at Jared Polis' record on education. Polis has pushed for conservative ideas that have undermined public schools," the ad attacking Polis says. “Like backing a radical school voucher bill while serving on the state ed board."

Polis did support a 2003 pilot bill that would have provided public money for private schools, but that was as a private citizen. There was no action taken on the measure while he served on the state Board of Education. Polis says he also has changed his mind and no longer supports any voucher legislation.

So it is misleading to imply he took official action on vouchers or currently supports it.

“Or funding multiple charter schools," the ad says.

It is fact that a foundation Polis runs funds multiple charter schools that help recent immigrants and homeless youths.

"Or saying we should fix Bush's ‘No Child Left Behind’ disaster rather than end it," the ad says.

It is fact that on his campaign Web site Polis said No Child Left Behind legislation should be fixed. Fitz-Gerald has said she supports ending the program.

Polis’ response to the ad attacking him, which is run by a group called Colorado Counts, attacks Fitz-Gerald, alleging she is responsible for the commercial and she is going negative.

"It's politics as usual ... Joan Fitz-Gerald's resorted to a negative campaign attacking Democrat Jared Polis," the Polis ad says.

It would be a violation of federal law for the Fitz-Gerald campaign to coordinate with a 527 like Colorado Counts, and the Polis campaign has not filed any complaints alleging a violation.

However, Steve Adams, a former AFL-CIO president who runs Colorado Counts, has given money to Fitz-Gerald’s campaign and so has another member of the lobbying firm where Adams works.

On the whole, however, it is fiction to say Fitz-Gerald resorted to negative campaigning.

“Negative ads run by oil lobbyists," the ad says.

Adams' lobbying firm has oil lobbyists and other clients. So it’s misleading to say the ad was put up only by oil lobbyists.

"She sponsored a bill to increase oil company profits, and Joan Fitz-Gerald is the only candidate to accept thousands from big oil special interest PACs," the ad says.

It is true Fitz-Gerald championed a bill that would have allowed oil producers to reduce royalties and Fitz-Gerald, unlike Polis, accepts Political Action Committee money. So this claim is fact.

The Fitz-Gerald campaign points out Polis, who self funds most of his campaign, accepts money from people who run or work in oil companies and owned stock in oil firms. Polis' campaign counters that taking PAC money is different because it is money specifically designed to influence politicians.

Fitz-Gerald, Polis and a third Democrat, Will Shafroth, face off August 12 in the Democratic Primary.
